DISCLAIMERS & CONTRACT AGREEMENT

· It is understood Expect Style Photography & DJ Music is the exclusive official DJ Music company retained to perform music services requested on this Contract.

· Client hereby engages the DJ to provide a DJ Service. The service to be performed at Event Location stated on this contract. The DJ service shall consist primarily of providing musical entertainment by means of a recorded music format and to render professional services and to have complete control the DJ equipment, music selections and program.

· Services requested that exceed the time specified on this contract will result in a last minute add-on fee of $100 per hour. It may not always be possible to provide additional performance time. However, when feasible, requests for extended playing time may be able to be accommodated.

· Client waives Expect Style of all responsibility and/or accountability for music not played during event including music that was requested in advance. Client waives Expect Style of situations beyond the DJ's control (e.g., failure or noncompliance of other vendors hired by client, family or friends of Client, weather, poor wiring, power surges, etc.). Client waives the DJ of any activities that were not included at the event but may have been discussed over the phone or placed in writing on a timeline planning sheet. It will be the client’s responsible to work with the DJ when specific activities are to happen at the appropriate time at the event. If you have specific requests of music titles you would like played at an event, all requests must be submitted at least three weeks before the event along with a timeline for your event or if a wedding party, the official Expect Style reception planning form, and Expect Style will consider all such requests but makes no guarantees as to requested music being played or any activities suggested on your timeline or reception planning form that were not played at your event or to activities that did not occur during your event.

· It is hereby further agreed that the Client shall be held liable for any injury or damages to the DJ, or property of the DJ, while on the premises of said engagement, if damage is caused by Client or guests of the Client, members of his organization, engagement invitees, employees, or any other party in attendance, whether invited or not.

· Expect Style may substitute another DJ to play music in the event of the DJ’s illness or of scheduling conflicts. DJ will play at the event only if all fees have been paid in full prior to the event and if this contract has been signed and received by Expect Style.

· Expect Style reserves the right to use images from the event for advertising, display, publication or other purposes.

· To reserve any potential or actual date or if you want Expect Style to hold a specific date, a reservation charge/deposit is required and is non-refundable. To book an event, this contract is required before any services can be performed, and we must receive this contract within 7 days after booking with Expect Style even if the booking was made verbally over the phone. Once a reservation is made, Expect Style reserves the time & date of the event. For this reason, any deposit/reservation charge paid is non-refundable, even if the date of the event is changed or cancelled for any reason. If additional payments have been made beyond the reservation charge which was required to book the event and the event is cancelled for any reason, Expect Style will not refund any amount whatsoever 6 months (182 days) before any event.

· If Expect Style cannot perform this Contract due to fire or other casualty, strike, act of God, or other causes beyond the control of the parties, or due to DJ’s illness or emergency, then the DJ shall return the reservation charge/deposit to the Client but shall have no further liability with respect to the Contract. This limitation on liability shall also apply in the event that DJ music or equipment is damaged or malfunctions or otherwise lost or damaged without fault on the part of the DJ. In the event Expect Style fails to perform for any other reason, Expect Style shall not be liable for any amount in excess of the music service fee or the amount of Client’s order.

· The charges in this Contract are based on Expect Style's Standard Price List. This price list is adjusted periodically. Any delays beyond 7 days to book event may result in a price change. Client will be charged a fee if check is returned for insufficient funds.

· Expect Style does not guarantee the sound acoustics of the room, the power wattage in the room or location, surges in power during the event, power outage, or voices heard or not heard through a microphone when supplied at the event or any other interference in the sound system or speakers.

· Expect Style will not be responsible for music or items left at the event even when a client provides music on a CD. It is the individuals responsible to collect any music given to DJ after the event.

· At an event location, Expect Style will follow all guidelines and requests of the facility’s management or individual in charge of the facility. For example, some room locations may require that music volume not go over a certain level; if this is the case, Expect Style will follow those instructions of the facility although the client may request music to be played louder. Expect Style will follow specific setup instructions of the facility regarding the setup of our lighting and equipment. Expect Style will make any and all determinations to the size of speakers, type of equipment used at event including lighting equipment we bring to an event based on our experience and in agreement with the facility’s management.

· This Contract incorporates the entire understanding of the parties. Any modifications of this Contract must be in writing and signed by both parties. This contract must be signed before services are provided. Expect Style and it’s staff and/or management reserve the right to cancel this contract at any time and will refund any money paid on account.
