DISCLAIMERS & CONTRACT AGREEMENT
· It is understood that the
Client(s) understand all disclaimers & company policy in this contract in
addition to disclaimers on our Web site.
It is understood that Expect Style Photography & DJ Music is the
exclusive official photography company retained to perform photographic
services at your event. If this contract is for wedding ceremony, Client’s
family and friends shall be permitted to take a snapshot as long as they remain
seated since Expect Style photographer(s) move around during the ceremony.
· At your event, when poses or
portrait poses are arranged by Expect Style photographer(s) such as group
posing or posing of the bride and groom, wedding party or other groups or
individuals, it is strictly prohibited for any other individual to use a camera
or recording device at such time. In the event others are photographing when
Expect Style photographer(s) are working or arranging poses, the obligations of
this contract will be fulfilled and completed even if another ending time was planned
and Expect Style will leave the event. It is understood that Expect Style
photographer(s) WILL NOT continue to take any photos or work with any Client if
there are other “amateur” photographers or when Expect Style photographer(s)
feel that they cannot continue due to interference by others. When others are photographing and/or if
Expect Style photographer(s) feel that their work is being infringed upon, Expect
Style photographer(s) will either leave the event or wait until any others are
no longer using cameras.
· During a reception, persons
are asked to hold all flashes until Photographer has obtained their
“shot." It is the client’s responsibility to ensure family and guests are
fully aware of this agreement. Any breach of this agreement shall constitute a
reason for non-completion of the job with no liability to Expect Style and
shall result in the loss of any monies paid by Client. Client, Bride, and Groom
understand and agree that a critical photograph can be obstructed by a guest
trying to get the shot and flashes other than those produced by the
Photographer may overexpose the photograph.
Disposable cameras are welcome at the reception and may be used;
however, Expect Style photographer(s) need to be the primary person taking the
key photos.
· This contract is for the
photography service fee and booking of service only. Optional items such as
prints, images and albums are purchased after all image proofs have been
uploaded on the Web site and remains optional items purchased separate from
this contract.
· After the event, picture
proofs will be placed on www.ExpectStyle.com approximately 6-8 weeks after the
event (peak seasons may require additional time). Images placed on Expect
Style's Web site are in Web proof quality and size. All proofs shown are the
only images available for purchase although other photos may have been taken at
the event; Photographer reserves the right to select images from the event and
Client waives Expect Style of all responsibility and/or accountability for
photographs not captured due to situations beyond the photographers control
(e.g., failure or noncompliance of other vendors hired by client, family or
friends of Client, weather, poor lighting in building, lighting outside, etc.).
Our services include posting of images from event and booking party shall
inform guests that images will be posted on our Web site. Keep in mind that you may be on limited time
at your ceremony or reception location.
We may plan a timeline for photography, but we cannot be liable for
delays.
·Ordering of prints, albums
or CD/DVD of images shall take place after image proofs have been uploaded
using the current order form on the Web site. Cropping of images may result to
accommodate sizes ordered which may vary from the proof shown and a border may
be added to top or sides as necessary. All images photographed by Expect Style
shall be printed with the photographer's name, company name and copyright
symbol.
· Expect Style Photography
may substitute another photographer to take the photographs in the event of the
Photographer’s illness or of scheduling conflicts.
· No part of any order,
including previews or proofs, will be delivered or displayed until the balance
is paid in full and/or this contract has been signed.
· Expect Style reserves the
right to use images and/or reproductions for advertising, display, publication
or other purposes. Images and previews remain the exclusive property of Expect
Style. Client shall not sell any images or use the images in advertising or any
publications without written permission from Expect Style and if such
permission is granted, a contract will be signed separate from this contract
with specific details regarding such use and conditions of use.
· To reserve any potential or
actual date or if you want Expect Style to hold a specific date, a reservation
charge/deposit is required and is non-refundable. To book an event, this
contract is required before any services can be performed, and we must receive
this contract within 7 days after booking with Expect Style even if the booking
was made verbally over the phone. Once a
reservation is made, Expect Style reserves the time & date of the event. For
this reason, any deposit/reservation charge paid is non-refundable, even if the
date of the event is changed or cancelled for any reason. If additional payments have been made beyond
the reservation charge which was required to book the event and the event is
cancelled for any reason, Expect Style will not refund any amount whatsoever 6
months (182 days) before any event.
· If Expect Style cannot
perform this Contract due to fire or other casualty, strike, act of God, or
other cause beyond the control of the parties, or due to Photographer’s illness
or emergency, then the Photographer shall return the reservation charge/deposit
to the Client but shall have no further liability with respect to the Contract.
This limitation on liability shall also apply in the event that photographic
materials are damaged in processing, lost through camera malfunction, picture
storage/memory device, lost in the mail, or otherwise lost or damaged without
fault on the part of the Photographer. In the event Expect Style fails to
perform for any other reason, Expect Style shall not be liable for any amount
in excess of the photography service fee or reservation charge.
· Client is aware that color
dyes in photography may fade or discolor over time due to the inherent
qualities of dyes and Expect Style does not guarantee the life of images on a
CD/
· The charges in this
Contract are based on Expect Style's Standard Price List. This price list is
adjusted periodically. Any delays beyond 7 days in returning this contract may
result in a price change. Client will be charged a fee if check is returned for
insufficient funds.
· NOTICE OF COPYRIGHT: It is
ILLEGAL to copy or reproduce your event photographs elsewhere without
Photographer’s written permission and violators of this Federal Law will be
subject to its civil and criminal penalties.
· Expect Style does not
guarantee images from the event stored or placed in storage or posted on our
Web site beyond 6 months after the event; therefore, it is Client's duty to
order images and other items desired within 6 months after the event. If after 6 months, and if images are still
available from Expect Style, Client may inquire about ordering pictures from proof
sheets. If this is the case, Client will
need to order proof sheets and pay for each sheet (see Web site for current
information regarding proof sheets and the cost of sheets). When ordering prints from proof sheets, Client
will need to order in a specific time period and will need to pay the current
advertised price of prints using the current order form. If a movie show has been made from the event
images, movie shows are also available online for a limited time only, e.g., 30
days.
· This Contract incorporates
the entire understanding of the parties. Any modifications of this Contract
must be in writing and signed by both parties. A contract must be signed before
services or images are produced. Expect
Style and it’s staff and/or management reserve the right to cancel this
contract at any time and will refund any money paid on account.
· If booking any other
service with Expect Style, such as DJ Music services, a separate contract must
be completed separate from this photography contract.
· If you are booking this
photographer services for a group or other individuals such as the bride or
groom, it is your responsibility to provide a copy of this contract to all
concerned parties.
